As a user of our website and services, including, but not limited to, PINSTACK (“PINSTACK”, “the Company,” “we”, “our”, or “us”) and our associated website (collectively, the “Service(s)”) we provide you with this Privacy Policy (this “Policy”), which is intended to describe in a straight-forward and easily understandable manner: the information we collect about you; how that information may be used; how we retain or otherwise process that information; with whom the information may be shared; how you may update the information you provide us; how you may contact us; and your choices about the information.

This Policy, along with our Terms of Use, which are incorporated by reference, constitute a legally binding agreement between you and PINSTACK that conditions your interaction with the Service, where and as permitted by applicable law and regulation (collectively, “law”).

We Collect Personal Information from and about You
We collect information when you interact with our Services, for example, (1) when you visit and use our website, (2) when you email us, submit forms online, or make purchases, (3) when you call, text, message us, (4) engage with loyalty app (PINSTACK PERKS) membership, or (4) when we are otherwise in communication with or providing products or services to you.
Certain information we collect may be “Personal Information,” meaning information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a natural person or household, such as a name, postal address, e-mail address, telephone number, and/or payment information, and subject to exceptions under applicable law, which may include information that is publicly available.
The Personal Information we collect or receive varies depending on how you interact with us. Depending on that interaction, we collect the following categories of information:
Identifiers, including Contact Information and Device Information
This may include your name, address, telephone number or e-mail address. For example, we might collect this Personal Information if you sign up for an online account or subscribe to our newsletter. We may also collect information regarding the type of device you use to access our Services and collect your device identifier, IP address, or mobile operating system.
Account Information
We collect information in order to provide you with an account, including email address and password, in addition to name and contact information.
Payment Information
For example, we may collect your credit card number and billing address when you make purchases from us.
Communications, including Electronic and Audio, from You
We may collect Personal Information you post in a public space, such as when you leave an online review. We may also collect Personal Information, as well the content of your messages, when you send us a message through the “Contact Us” page. We may also collect audio recordings when you contact us. We may also collect information such as survey responses when you are responding to a survey. We may use third party tools for the collection of this information, as described further below.
Social Media Information
We may collect Personal Information you post on our social media pages. We may also collect your social media profile information and information posted on your page.
Demographic Information
We may collect your birthdate, age, gender and zip or postal code. We may also collect information that could identify you and relates to your hobbies, interests or purchasing behavior.
Commercial Information, including Purchase History
We may collect Personal Information about the purchases you make online or in our cinema. This could include the products you purchased and their prices. We also collect information about the services you have purchased.
Internet or other Electronic Network Activity Information, including Product and Service Usage Information
We also collect information about when and how people visit and interact with our Services, including our website, including what pages they accessed, and their interaction with the website and its features, such as videos. We might also observe what site you came from, or what site you visit when you leave us. We might also review information regarding your interactions with our communications, such as email. We also receive information to help detect and prevent consumer fraud, including but not limited to browser and keyboard language settings, whether data is automatically filled or manually entered, whether data is manually or copy pasted, and proxy detection. We and/or our partners may use tools, including from third parties, to collect some of this information.
Location Information
For example, we may collect precise location information from your device to provide you with Services. This may include information about your exact location.
Video Surveillance Footage in our Cinemas
We use video surveillance in our cinema to detect and address security and safety incidents, potentially illegal activities, and adequate staffing considerations. If you enter our storefront, your images may be collected for these purposes.
We Collect Personal Information in Different Ways
We limit Personal Information collection to what is adequate, relevant, and reasonably necessary in relation to the purposes disclosed.
We collect Personal Information directly from you.
For example, if you create an account or make a purchase on through our Services, we collect your Personal Information. We may also collect your Personal Information if you sign up for promotional emails, contact us, or interact with us online, engage with our loyalty application (“PINSTACK PERKS”) or with our social media sites.
We collect Personal Information from you passively.
We collect Personal Information about users over time and across different websites, apps, and devices when you use the Platform. Our vendors and partners may also collect Personal Information this way on our Services. For example, this may include when you enable location-based features or click on sponsored links or third party advertisements. We may also use cookies, web beacons, flash cookies, and other tracking technologies for these purposes.
Information Collection Technology (Web Beacons and Cookies)
We may use various technologies to collect information from your electronic device about your activities using the Service. We may collect and store non-personally identifying information through cookies, log files, clear gifs (commonly known as “web beacons”), and third parties to profile user activity and preferences. Technical and specification information about your device and settings may be collected when you use the Service. This information may include your Internet Protocol (“IP”) address, your browser type, operating system, access time(s), the content of previously accepted “cookies” from us, and the website address that referred you to our Services.
A cookie is a small file that downloads when you access certain websites. They are data stored on your device that tracks non-personal information about you. When using our Service, we may assign your device one or more cookies that enable us to improve the quality of our Service and to personalize your experience. Cookies allow us to automatically collect information about your activity on our Service, such as the content you access while using our Service, the links you click, and other activity you conduct while using our Service. Our Service may contain web beacons (also known as “clear gifs”) or similar technologies that gather non-personally identifiable information about your use of our Service. Such technology may also be contained in e-mail messages or newsletters from us that allow us to determine whether messages have been accessed. The purpose of our use of this technology is so that we may analyze the effectiveness of our marketing efforts and the quality of our Services.
We get Personal Information from Third Party Sources.
We may obtain information about you from third party sources, such as Google, Apple, Hubspot and fraud detection and prevention service providers. We may also use information from public sources to meet legal and regulatory requirements.
To enhance security and promote operational efficiency, the Service utilizes the resources of reputable hosting facilities that may be controlled by third parties, including but not limited to Hubspot. The Company is unable to provide any guarantees or warranties about these third parties’ retention or usage of your information, and you agree to look at and obey the privacy policy and terms of all such third parties.
If the Company obtains information from third party sources, you agree that your sole legal remedy for any harm associated with that information is against the third party that provided the information to us, and that you will not assert any cause of action, claim or demand against us other than requesting we delete any erroneous information.
We Combine Personal Information.
For example, we may combine Personal Information that we collect offline with Personal Information we collect through our website. We may also combine Personal Information we collect about you from the different devices you use to access our Services. We may also combine Personal Information we get from third parties with Personal Information we already have about you. This information may be utilized, analyzed, and/or compared with information that the Company has collected from you or that you have submitted to the Service.
We use Personal Information as We Describe.
We use Personal Information to provide Services. We use Personal Information to improve our understanding of your interests and concerns, and improve our Services. We use Personal Information to communicate with you, including to respond to your requests, messages, or questions. We use Personal Information for security and legal purposes. We use Personal Information for advertising and marketing purposes. We use Personal Information to administer or communicate with you about your account or our relationship.
We use Personal Information for other purposes. For example, we use Personal Information to maintain transaction and other business records. We will do this for as long as we deem necessary to fulfill the business purpose for which the Personal Information was collected. We also use Personal Information for internal purposes as permitted by law. This includes administrative and audit purposes. We also use Personal Information to meet legal, insurance and processing requirements. We will also use Personal Information as otherwise allowed by law, including if we have notified you. In some circumstances, we may seek your permission, for example, if we are legally required to do so.

We may match, use, and share any of the information we collect from you to any personally identifiable information we obtain through third parties. Examples of some ways we may use or share information that we collect about you include: providing you with products or Services, whether from the Company, or any affiliates or sponsors; providing you with customized content, advertising, and services; providing technical or customer support; performing research and analysis to gauge the use of the Service; communicating with you by e-mail, postal (“snail”) mail, telephone, text message, and/or mobile devices about products or services that may be of interest to you from the Company, any affiliates, sponsors or other third parties; enforcing the Company’s terms and conditions, or otherwise manage its business; complying with the law or to protect ourselves, as permitted by law; at your direction, including with third parties for payment purposes; providing our affiliated companies information for purposes including internal audits, management, billing or administrative services, or to provide you with the same level of service; providing our successors to all or part of our business the information for substantially the same purpose as set out in this Policy; and performing functions as otherwise described to you at the time of collection.
In order to perform certain services on your behalf, we may publish certain information that you provide. You agree that any testimonial feedback or other comments provided by you to the Company becomes its sole and exclusive property and that such information may be used for any legally permissible purpose, including, but not limited to marketing and advertising our Service.
You acknowledge and agree that the Company may use and disclose your personal and non-personal information to public or private third parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; (iii) to enforce or apply the terms of this Policy or any other agreement between us; and (iv) to protect our, our users, and others’ rights, property, or safety whether during or after the term of your use of our Service.
Your Information Will Not Be Sold
We will not sell any information you submit to us to any other third party without prior written notice to you and an opportunity to opt-out; however, you agree that we do not need your permission nor any advanced notice from Us to sell all or substantially all of Our assets, including but not limited to your personal information, to a third party in the general course of business.
Third Party Privacy Policies May Be Applicable
This Policy does not cover any third party’s use or handling of your information once it is shared, including third party sites accessed from our website. Instead, the privacy policy of the third party will govern. We strongly encourage you to fully read and understand their privacy policies of all third party sites you visit to find out how they are treating your Personal Information. Some of these entities have different privacy terms than we do and their servers may be located outside the United States. We are not responsible for these third parties’ practices.
Information Retention
For each category of Personal Information listed above, we retain the Personal Information for as long as is necessary to fulfill the purpose for which it was collected, including to satisfy legal, accounting, or reporting requirements and, where required for us to assert or defend against legal claims, until the end of the relevant retention period or until the claims in question have been settled.
We use the following criteria to determine how long to retain Personal Information: our relationship with you; your requests to us regarding your Personal Information; any legal obligations to retain the data, or for our own legal purposes; and technical considerations, and level of protections in place for your Personal Information.
Security
We use standard security measures. We cannot guarantee that any of your Personal Information stored or sent to us will be completely safe. We encourage you to use caution. We take reasonable security measures to protect Personal Information under our control against unauthorized access, loss, alteration, or destruction. These measures include encryption and physical security measures to guard against unauthorized access to systems where we store personal information, and the usage of reputable third party vendors. Despite these reasonable measures, we cannot guarantee our security measures are impenetrable. Therefore, although we take reasonable steps to secure your information, we cannot and do not promise or warrant that your information will always remain secure. A username and a password are needed to access certain Services. It is your responsibility to protect your username and password.
To the maximum extent allowed by applicable law, you agree and acknowledge that Company will not be liable or responsible if any information about you is intercepted, accessed, and/or used by an unintended recipient. If you have reason to believe that the security of your communications or Personal Information has been compromised, please notify us immediately using the contact information below.
Rights Regarding Your Personal Information
You, but Texans and Virginians in particular, have certain rights regarding how we use your Personal Information pursuant to the Texas Data Privacy and Security Act and the Virginia Consumer Data Protection Act. You will not be discriminated against for using your rights. Certain rights are browser and device specific.
Knowing How your Data is Being Processed
You have the right to know whether we have your personal data, will process your personal data, and obtain your personal data that we have in a readable format.
Data Integrity and Correction
You have the right to request to view and correct personal information from the Site. Such requests may be submitted using the contact information in the “Opt-Out Provisions and Updating Your Information” section below.
If your personal information changes, you have the right to update or request deletion of information collected on our Site, or if you believe a third party has provided us with your personal information and you would like to request that it be edited or removed from our database, please use the contact information in the “Opt-Out Provisions and Updating Your Information” section below. We will respond to all access requests within 45 days. This time period may be extended by an additional 45 days when reasonably necessary after providing a reason for the same within the initial 45 day time period.
Communications from Us
You can opt-out of receiving our marketing communications. Unless you opt-out of certain communication features, we may use your information to communicate with you, such as through e-mail, newsletters, and telephone. You may opt-out and/or unsubscribe to promotional communications at any time. See the Opt-Out Provisions and Updating Your Information section below for applicable contact information and directions. Note that you will still receive transactional messages from us, including information about your account and responses to your inquiries.
Opt-Out Provisions and Updating Your Information
We value our user’s privacy and provide them with the option to “opt-out” of having their information used for purposes not directly related to our Service, including targeted advertising. The opt-out option is available at the time you sign up for your account. If you wish to change your opt-out preference or update your information after you initially sign up for your account, you can opt-out by any of the following means: send a written request to the address listed at the bottom of this Policy; unsubscribe directly through links in our e-mails; or send an e-mail to: [email protected].
We will first acknowledge receipt of your request within ten (10) business days after receipt of your request. We may also request further information to authenticate your information, as well as the information requested. We will provide a substantive response to your request within 45 calendar days after its receipt or as otherwise required by law. If we require more time (up to an additional 45 days within the permitted timeframe), we will inform you of the reason and extension period in writing, as well as instructions for appealing the decision.
Please note that changing your opt-out preferences will only affect future activities or communications. For information to a third party before changing your opt-out preferences, you will need to contact the third party directly. To opt-out of communications from the Company’s third party business partners, if any, please contact them directly. You may also authorize an agent to submit a request on your behalf, so long as you provide the authorized agent written permission to request on your behalf, and your authorized agent is able to verify his or her identity with us. Only you or an authorized agent may make a verifiable consumer request related to your Personal Information.
Notice about Social Security Numbers
We do not collect social security numbers of clients. If we come into possession of users’ social security numbers or collects such information in the future, the information will be treated confidentially and not shared with third parties unless allowed by law. Additionally, we will take reasonable steps to limit the access to the social security numbers and take legally required steps of securing the transmission of the data.
Personal Information About Users Under 18 Years of Age Not Collected
The Service is meant for adults and those who have reached the age of majority as defined by the laws of their domicile. The Service is not meant for individuals under the age of eighteen (18) or those defined by the laws of their domicile as minors. Nonetheless, this Policy is still designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) to the extent COPPA applies to the Company. Accordingly, the Company does not knowingly collect or retain any personal information about users under the age of thirteen (13). If we receive information about a child under the age of thirteen (13), that information will be promptly deleted from our database and all other media. Since we do not knowingly collect information from users who are under thirteen (13) years old, no such information is disclosed to third parties.
We note, however, that we will only knowingly receive, process, and store information on those who are under the age of thirteen (13) with parental consent. We take steps to maintain the privacy of that information. We do not share it with any third parties who do not have a reasonable need for such information related to the provision of the Service. We aim to collect the minimum amount of information necessary to provide the Service to individuals under the age of thirteen (13). The following type of information may be kept: name, email address, and birthday (day and month). If you are a parent or legal guardian and think your child has given us information, you can contact us, as identified below. Parents of children under the age of thirteen (13) have the right to review and ask for the deletion of the personal information kept on their child(ren). You can request access to this information by contacting us at the contact information listed on the bottom of this policy.
Visitors Outside of Texas, Virginia, North Carolina, and the United States
This Policy is intended to cover collection of information on our Service from residents of Texas, Virginia, North Carolina, and the United States. The laws in other countries may or may not be as comprehensive as those in Texas, Virginia, North Carolina, and the United States. If you are a resident of another state or country and/or are using our Service from outside of Texas, Virginia, or North Carolina, you acknowledge and agree that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. You also acknowledge that your use of our Services shall be governed exclusively by the laws of Texas and as if all transactions take place within Texas. By using our Service, you acknowledge and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy. If you are unwilling to accept these terms, then you agree that you will not use or access our Services.
Privacy Policy Updates and Revisions
This Policy may be updated from time to time. We reserve the right to modify the Policy at any time without notice, so please review the Policy frequently. When changes are made to this Policy, we will revise the “last updated” date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your personal information, we will also post notice of the changes on the Service and/or may notify you by sending an e-mail to the e-mail address you most recently provided us in your account. Your continued use of our Service after we have posted any Policy changes indicates your agreement to the changes unless you notify us within ten (10) days of the effective date of the update to the Policy.

Terms of This Policy Survive
If any terms of this Policy are held invalid and/or unenforceable by a court of law or a competent jurisdiction, the remaining provisions of this Policy shall remain in full force and effect.
Limitations
The Company is not a financial institution or other entity required by law to adopt or publish this Policy or any other privacy policy. The adoption or publication of this Policy does not subject the Company to any stricter duty in its collection, handling, storage and disclosure of nonpublic information than otherwise applies to the Company under applicable law. No person or entity shall have any right or recourse against the Company, its affiliates, agents, sponsors, or other related parties based on any alleged violation or noncompliance with this Policy.
